Rationale of fair use for Can't Take That Away (Mariah's Theme)

The image Image:Mariahcareysingle ctta.jpg is being linked here; though the picture is originally copyright, I (Extraordinary Machine 21:14, 9 July 2006 (UTC)) feel it is covered by fair use because:

  1. No free or public domain images have been located for this single.
  2. The image is of lower resolution than the original cover. Copies made from it will be of inferior quality, and could not be used as artwork on illegal vinyl or CD copies of the single.
  3. The image does not limit the copyright owners' rights to distribute the single in any way.
  4. For an article about a single, the cover artwork is arguably one of the most important images that could be included. This is the artwork, intended by Columbia Records for wide distribution. As such, it has future historical significance, and is a more appropriate choice than any other image available.
  5. This image is used on various websites, so its use on Misplaced Pages does not make it significantly more accessible or visible than it already is. The cover is being used for informational purposes only, and its use is not believed to detract from the original single in any way.
