The above rationale fails to explain why this image is permitted to be used in the article according to our fair use criteria, specifically point 3: "The amount of copyrighted work used should be as little as possible." and point 8: "The material must contribute significantly to the article (e.g. identify the subject of an article, or specifically illustrate relevant points or sections within the text) and must not serve a purely decorative purpose." - The cheque shown in this photo is not mentioned elsewhere in the article.

The image linked here is claimed to be used under fair use as:

  1. it is a historically significant scanned image of a check to famous individual Harry Aubrey Toulmin, Sr., the subject of the article, from famous individuals the Wright Brothers;
  2. it is of much lower resolution than the original (copies made from it will be of very inferior quality)
  3. the image of the check will be 100 years old next May, 2007.
  4. the scanned image is only being used for informational purposes.
  5. Its inclusion in the article adds significantly to the article because it is tangible evidence of a business relationship between Toulmin and the Wright Brothers, it conveys what Toulmin expected to receive from the relationship, and, since it may have been money that ended the relationship between Toulmin and the Wright Brothers as mentioned in the article, the check conveys a powerful message about their relationship.
