These settlements have been declared to be illegal by the UN Security Council (Resolution 446), and Israel was been order by that resolution to cease further settlement activity. Israel is obliged under the UN Charter to accept this decision, but has refused to do so.
Israel claims that the territories in question are not claimed by any other nation (both Jordan and Egypt withdrawing their claims to these lands as parts of their peace agreements with Israel). Therefore Israel does not see the territories as occupied in the traditional sense and subjects to the Geneva conventions.
