Fair Use for Asteroids (game)

I believe this videogame screenshot should be considered fair-use because:-

1. It is used solely to improve the article's quality.
2. The image used was created by the uploader and was taken from an emulator.
3. No free-use image for this game exists.

This image is a screenshot from a video game, and its copyright is most likely held by the game's publisher or developer. It is believed that the use of low-resolution screenshots to visually identify the game in question on the English Misplaced Pages, hosted on servers in the United States by the non-profit Wikimedia Foundation, constitutes fair use under the Copyright law of the United States.
