A "test case" for the new law's enforcement and application.)" Might conceivably become notable eventually, if it reaches the appellate courts, but its still at the first level of jurisdiction. Additional justification "e first person in Western New York charged with Drunk Driving with an enhanced felony DWI" -- not even first person in NY. To my view, a textbook case of DO NO HARM.
