The description states that the image is a still from a German TV show. As such, the copyright is almost certainly owned by the company that produced the show and not Mark Bellinghaus, as the upload comment claims. But even if Mr. Bellinghaus does own it, one cannot legally assert ownership of copyright and, at the same time, release it into the public domain. Hux (talk) 00:19, 31 August 2008 (UTC)

- Eastmain: I applaud you for attempting to bring the image into conformance with Misplaced Pages's rules. However, sadly I think the rationale you added is significantly wide of the mark: the image's use contravenes fully half of the points you list in "purpose of use" (points 3, 5, 6, 8, and 10, to be specific). The image is easily replacable, non essential and purely for decorational purposes. The image does not add any information to an article besides the photo's themselves, which are freely available in the Public Domain in other images. effeietsanders 18:21, 31 August 2008 (UTC)
- This image is listed on the wrong list, I think since noone is contesting that it is unfree, as all logos are; in fact, its image page states that it is copyrighted by the 2008 McCain presidential campaign. Nonetheless logos are acceptable on Misplaced Pages to illustrate the organization they designate. This particular logo features likenesses of the two individuals of the named on the campain's ticket, McCain and Palin, much as various logos featuring Paul Newman's image designate "Newman's Own" products and distinguish them from products of competitors'. The logo of a campaign is not replaceable and it is not "purely for decorational purposes." It qualifies as fair use to use it in the Sarah Palin article, just as the Obama/Biden campaign logo qualifies as fair use in the Joe Biden article. Rreagan007 (talk) 21:16, 31 August 2008 (UTC)
- Closed without prejudice - this is not the correct process. You may either use {{subst:refu}} to ask that an admin examine this image or you may nominate it at WP:IFD for broader consideration. Aparently tagged as PD-USGOV because the uploader could not find a tag for images from the State of Kentucky, no wonder considering that both the source website and the main Kentucky.gov westite both state:

General question
I'm trying to figure out whether US copyright law overrides law in other countries, specifically, if another country says a work published therein is public domain, is that overridden by this little gem, so that more restrictive US copyright renders the image non-free? Where is the best place to ask this question? (Navigating the copyright pages in Misplaced Pages is almost as hard as reading the copyright rules IRL!). Thanks!
