In 2002, Ciccone and Gambino crime family boss Peter Gotti were indicted on charges of exerting illegal control over the New York City waterfront and extorting money the water terminal businesses. The indictment alleged that the Genovese and Gambino families still controlled the city waterfronts.
In March 2003, Ciccone was convicted of the accusations and is currently serving time at the Fort Dix Federal Correctional Institution (FCI) in Fort Dix, New Jersey. He is scheduled to be released at April 24, 2013..
